on the protection of animals
Chapter I
General Provisions
Article 1
(1) This Law regulates the measures necessary for ensuring the conditions of life and welfare of the animals with or without the owner.
(2) Managing the canine population with the master on the Romanian territory is regulated by special law.
Article 2
The purpose of this law, the owner of the animal owner is the person who holds any valid, and any natural or legal persons whose care is the animal.
Article 3
Animal owners are required to ensure the health rules and zooigiena on housing, feeding, care, reproduction, exploitation, and those relating to the protection and welfare of animals.
Article 4
Animal owners are required to take an uncompromising brutality against them, to ensure the basic conditions necessary for the purpose for which they are raised, and not to leave or eject.
Article 5
(1) Holders of animals are required to provide them, according to the needs ethological, species, breed, sex, age and type of production, the following:
a) a proper shelter;
b) sufficient food and water;
c) the possibility of moving enough;
d) care and attention.
(2) owners of animals are prohibited ill-treatment to apply, such as percussion, and other such schingiuirea cruelty.
Article 6
(1) For the purposes of this law, bad treatment by the brutal means, the use of animal abuse, mistreatment and subjecting animals to unnecessary effort and neasigurarea minimum necessary conditions of life and their welfare.
(2) For the purposes of this Act, by cruelty to animals means:
a) killing the animals, the perversity, and by practicing fire on domestic or captive animals;
b) organizing fights between animals or animals;
c) the use of live animals for training or for dogs to control aggression;
d) use of animals for exhibition, advertising, film making or similar purposes, these activities if they cause their physical and mental condition or injury;
e) the abandonment of an animal whose existence depends on human care;
f) management of substances intended to stimulate the animal's natural abilities during sports competitions, as doping.
Article 7
Animals used for scientific purposes are subject to specific rules of protection, are not cause unnecessary suffering.
Article 8
(1) The National Sanitary Veterinary and Food Safety is national authority for the protection of animals.
(2) detinere conditions, housing and maintenance of animals shall be determined by order of President of National Authority for Sanitary Veterinary and Food Safety.
Chapter II
Conditions for holding animals
Article 9
(1) Holders of animals can run wild animals, by law, only if authorized by the Director Veterinary and food safety for county and city of Bucharest.
(2) Conditions of holding wild animals shall be determined by order of the minister of agriculture, forests and rural development, the proposal to the National Sanitary Veterinary and Food Safety.
Article 10
(1) Holders of animals are required to treat and care properly in an animal sick or injured.
(2) Sanitary Veterinary Authority may order the killing or cutting, if necessary, a sick or injured animals, to relieve the physical and mental suffering unnecessary conditions established by order of President of National Authority for Sanitary Veterinary and Food Safety.
(3) The provisions of paragraph. (1) and (2) shall not apply to animals used for scientific or other experimental purposes.
Article 11
Holders of animals selected for breeding an animal are required to respect the anatomy, physiology and behavior of the species and breed, so we can not compromise performance, health and welfare background.
Article 12
The person who contributes to enter an animal has an obligation to use means of training that does not cause physical or psychological trauma, and to use methods that do not prejudice the health or animal welfare.
Chapter III
Terms of trade in animals, animal transport, and use them for advertising in shows, exhibitions, competitions and similar events
Article 13
National Sanitary Veterinary and Food Safety, for the protection of animals or species of animals on the country, may impose certain conditions and limit or prohibit the import, export, transit and trade in animals, taking into account the Community regulations.
Article 14
(1) Carriers are required to transport animals in appropriate circumstances, depending on the species, sex, age, type of production, to avoid physical injury or exhaustion of them.
(2) conditions on the transport of animals is determined by order of President of National Authority for Sanitary Veterinary and Food Safety.
Article 15
Animals can be used for advertising in shows, exhibitions, competitions or other similar events only if:
a) organizer ensure conditions stipulated in art. 5; 5;
b) animal health and welfare are not put in danger.
Article 16
During competitions or elsewhere is prohibited to receive or animal substances to be subjected to procedures for increasing or decreasing the level of natural performance.
Chapter IV
surgery
Article 17
(1) Animals are subject to surgery only in cases justified.
(2) surgery is performed under local anesthesia or, if necessary, general, only by veterinarians.
(3) medical Manoperele which may cause the animal suffering should be performed by the veterinarian.
Article 18
By exception to the provisions of article 17. (2), in animals used for scientific purposes or purposes other experimental surgery or other treatments may be carried out and others who have the qualifications necessary.
Chapter V
Cutting or killing animals
Article 19
Pets will not be subjected to unnecessary suffering when cutting or killing.
Article 20
Slaughter of animals will be in compliance with specific legal provisions in force.
Article 21
Provisions of article. 20 does not apply to animals, due to accidents or diseases, have cut or killed immediately.
Chapter VI
Using animals for scientific purposes or purposes other experimental
Art. 22 Article 22
Animalele pot fi folosite pentru cercetare stiintifica, diagnosticarea de boli, producerea unor medicamente sau produse biologice, precum si in alte scopuri similare, atunci cand obiectivul activitatii nu poate fi atins prin alte metode ce nu implica folosirea animalelor. Animals can be used for scientific research, diagnosis of diseases, production of medicines or biological products, as well as in other similar activities when the objective can be achieved by other methods that do not involve the use of animals.
Chapter VII
Sanctions
Article 23
(1) constitute contravention following facts:
a) breach the provisions of article 12;
b) breach the provisions of article 5 (1);
c) subjecting an animal to ill-treatment;
d) non-compliance with article 26 (3);
e) subjecting an animal to cruel.
(2) Contraventions stipulated in para. (1) shall be sanctioned as follows:
a) at the point. a) with fine from 2,000,000 lei to 4,000,000 lei;
b) from the point. b) and c) with fine from 3,000,000 lei to 6,000,000 lei;
c) to the point. d) with fine from 6,000,000 lei to 10,000,000 lei;
d) to the point. e), with a fine from 10,000,000 lei to 20,000,000 lei.
Article 24
If it was committed three times over a period of 2 years of the facts stipulated by article 23 para. (1) c) and e) the owner of the animals, according to near fine, apply and measure seizure animals. In this case, houses animals in shelters are working around the local councils and are used under the law.
Article 25
(1) The application of sanctions infringements and people are empowered, under authority of the service within the National Sanitary Veterinary and Food Safety Authority and the Ministry of Administration and Interior.
(2) the offender can pay immediately or no later than 48 hours of the closing date of the minutes or, if necessary, from the date of communication, half of the minimum fine stipulated in article 23 (2), the agent found making mention of this possibility in the minutes.
(3) contraventions stipulated in article 23 are applicable provisions of Government Ordinance no. 2 / 2001 on the legal regime of contraventions, approved with amendments and completions by Law no. 180/2002, cu modificarile ulterioare. 180/2002, with subsequent modifications.
Chapter VIII
Final
Article 26
(1) The National Sanitary Veterinary and Food Safety Authority and Ministry of Administration and Interior, through the bodies, monitor implementation of this law.
(2) For fulfilling the provisions of this law, persons empowered under authority of the service within the National Sanitary Veterinary and Food Safety Authority and the Ministry of Administration and Interior have access to buildings, shelters and other places where animals are kept, and the right to request any information and documents necessary to control and take samples for research and laboratory tests.
(3) In case where animals are kept at home or residence of owners of animals, persons specified in para. (2) in this region is in agreement with the holder. In lipsa acordului, detinatorul de animale are obligatia de a face dovada respectarii dispozitiilor art. Without agreement, ownership of animals are required to furnish proof of compliance with article 5.
Article 27
Orders specified in article 8 (2), article 9 (2), Article 10 (2) and Article 14 (2) shall be issued within 6 months from the date of publication of this law in the Official Gazette of Romania, Part I.
Article 28
This law comes into force 10 days after its publication in the Official Gazette of Romania, Part I.
